General terms of use of the Planforlab platform and user information

The Fundación Empresa Universidad Gallega – hereinafter FEUGA, with Tax Identification Number (NIF) G15051667, registered office at Rúa Lope Gómez de Marzoa s/n, 15705 Santiago de Compostela, email address feuga@feuga.es, and registered in the Registry of Foundations of the Xunta de Galicia under number 155, provides Internet users with the PLATFORM www.planforlab.es (hereinafter, the PLATFORM) free of charge. Access to and/or use of the PLATFORM is entirely voluntary and grants the person who performs it the status of USER. Every USER accepts, from the very moment of access, without any reservation, the content of these “General Terms and Conditions” as well as, where applicable, the “Specific Conditions” that may complement, replace, or modify them in any way in relation to the services and content of the PLATFORM. Consequently, the USER must carefully read both before accessing and using any service on the PLATFORM under their sole responsibility. In any case, FEUGA reserves the right, at any time and without prior notice, to deny access to this site to any users who fail to comply with these general conditions or the specific conditions that may apply to them. Furthermore, we inform you that we comply with the obligation to have at least one of the domains we own registered in the corresponding registry.

Purpose and modification of terms

FEUGA offers USERS the possibility to browse and access the contents and services of the PLATFORM, provided they do so in accordance with these GENERAL TERMS AND CONDITIONS. In any case, FEUGA reserves the right to modify or remove the content, structure, design, services, and conditions of access and/or use of this site at any time and without prior notice, whenever it deems appropriate.

User responsibility

The USER undertakes to use the services and contents provided by the PLATFORM in accordance with current legislation, the principles of good faith, and generally accepted practices, and to refrain from any actions through the website that contravene public order. Therefore, any use for unlawful purposes or that harms or prevents, may damage and/or overload in any way the use and normal functioning of the PLATFORM, or that directly or indirectly affects it or any third party, is strictly prohibited.

The PLATFORM user shall not transmit through the service anything that goes against human dignity and values, in accordance with national and international standards on the protection of human rights.

The PLATFORM user agrees to provide truthful and accurate information about themselves in the registration form.

Likewise, the reproduction, distribution, transmission, adaptation, or modification, by any means and in any form, of the contents of the PLATFORM website (texts, designs, graphics, information, databases, sound and/or image files, logos…) and other elements of this site is prohibited, unless previously authorized by their legitimate owners or as permitted by law.

Any commercial or advertising use of the aforementioned content, other than that strictly permitted, is also prohibited, as is the violation, in general, of any rights derived from it.

The USER shall be solely responsible for the use of this site and for full compliance with these GENERAL TERMS AND CONDITIONS. Consequently, the USER undertakes to keep confidential and secure their access credentials, passwords, or similar data assigned for access to the PLATFORM or any of its services, and shall be liable for any damages of any kind resulting from misuse by themselves or third parties—either against the user, due to their own negligence, or against FEUGA as a result of non-compliance with these GENERAL TERMS AND CONDITIONS.

Any breach of these GENERAL TERMS AND CONDITIONS may give rise to appropriate civil, criminal, or extrajudicial proceedings against the user.

User registration

FEUGA reserves some of the Services offered through the PLATFORM for USERS who register by completing the forms accessible through the website. Nevertheless, FEUGA also offers certain Services that require USERS to complete additional registration processes.

FEUGA will process Personal Data automatically for the purposes and under the conditions defined in its Privacy Policy, which is included in this Legal Notice.

Disclaimer of warranties and liability

FEUGA does not guarantee and shall not be held liable, under any circumstances, for the following events and contents, nor for any damages that may arise from them:

Lack of availability, continuity, access, maintenance, and effective operation of the website and/or its services; accuracy, completeness, relevance, timeliness, and reliability of its contents, regardless of the cause, and any technical or other difficulties that may originate these events. The transmission or presence of viruses, other harmful elements, or programs that may affect users’ devices as a result of accessing, using, or browsing the site, or that may cause alterations to their electronic documents or files.

Illegal, negligent, or fraudulent use of the website and its services and contents by USERS, including impersonation of third parties or actions contrary to these general terms and conditions, good faith, generally accepted customs, or public order. Defects or faults in the contents and/or services accessed through the PLATFORM. Reception, storage, acquisition, distribution, or transmission of the PLATFORM’s content by USERS. Unauthorized third-party access to or use of any information regarding the characteristics and circumstances of how USERS use the PLATFORM’s content and services.

Non-compliance by third parties with their obligations related to the services provided to USERS through the PLATFORM, as well as the lack of quality, reliability, accuracy, legality, usefulness, or availability of services provided by third parties and offered to USERS on this site. The above list is merely illustrative and in no case exclusive or excluding in any of its points. In all cases, FEUGA DISCLAIMS ANY LIABILITY FOR DAMAGES OF ANY KIND ARISING DIRECTLY OR INDIRECTLY FROM THE ABOVE OR FROM ANY OTHER SIMILAR EVENTS NOT SPECIFICALLY LISTED.

Intellectual and industrial property rights

The texts, designs, images, databases, logos, structure, trademarks, and other elements of this site are protected by laws and international treaties on intellectual and industrial property. Any reproduction, transmission, adaptation, translation, modification, public communication, or any other exploitation, in whole or in part, of the content of this site, by any means or in any form—electronic, mechanical, or otherwise—is strictly prohibited without prior written authorization from FEUGA. Any infringement of these rights may result in civil, criminal, or extrajudicial proceedings as appropriate.

FEUGA does not grant any license or authorization for the use of any kind over its intellectual and industrial property rights or over any other property or right related to the PLATFORM, its services, or its contents.

Applicable law and jurisdiction

These general terms and conditions shall be governed by Spanish law.
